It is hereby stated that the word parador, and any distinctive device pertaining to the Puerto Rican Paradores Program shall be used exclusively by the Company, which shall be the sole entity with the legal right and capacity to authorize the use of the word and the distinctive devices of the Program.
Provided, as an exception, That the word paradores may be used to designate the name of an organization in which all its members shall be attached to the Puerto Rican Paradores Program. When submitting an application, the entity shall comply with the parameters established by the Department of State, and shall also include in its application a certificate issued by the Tourism Company, which confirms that said association effectively complies with the requirements of §§ 672—672d of this title, and shall render a quarterly report of its members to the Tourism Company. The association must have the approval of at least seventy-five percent (75%) of the lodgings that belong to the Puerto Rican Paradores Program as an essential requirement for its recognition and the resulting authorization for the use of the word paradores. The Puerto Rico Tourism Company shall be empowered to certify the failure of the association to comply with the legal requirements, as well as the lack of authorization for the use of distinctive devices of the Paradores Program, even after the incorporation of said entity.
The company shall establish and maintain a register of the authorizations granted which shall indicate those that have been canceled or suspended. Any authorization granted by the Company shall be subject to an administrative action of suspension or cancellation in case the establishment does not comply with the norms in effect or voluntarily decides not to participate in the Paradores Program.
