(a) Regulations on certification procedures.— The agencies are hereby authorized to prepare, adopt and amend regulations to establish and put into effect a system of certification of final plans and pertinent documents for construction projects of works that require a construction permit, as well as everything related to the inspection and supervision of the works, and to procedures for revising, correcting and/or penalizing faults in the certification process, in the plans and documents submitted, or in the construction of the work subjected to the endorsement, permit or approval, pursuant to the provisions of the Organic Act of each agency, and §§ 73-73 l of this title, without being subject to the provisions of §§ 2101 et seq. of Title 3.
The regulations shall cover the procedure needed for the filing of plans and certified documents with the purpose of obtaining permits and endorsements from the agencies.
In all the procedures related to the preparation, and adoption of and in the case of future amendments to these regulations, the agencies must work under the coordination of the Planning Board. It will point out the fundamental guidelines which the agencies must follow in the certification procedures. It shall also have the obligation of coordinating the work so that the certification procedures required by each agency are as uniform as possible.
Before adopting or amending these regulations in the future, the agency, always in coordination with the Planning Board, shall develop a direct consultation and public hearings process, after due notice to all parties that could be affected or committed once it is approved.
Before the regulations on the certification process of each one of the agencies take effect, they must be approved by the Planning Board and the Permit Management Office.
(b) Regulations, or technical specification codes for designs.— Each agency must prepare regulations or a code including all those technical specifications that, in its judgment, are necessary during the course of, and in the construction of the works. These regulations should give the professional who is to design and draw up the plans and documents to be certified, all the elements, requirements, and technical details which will allow him to design and draw up the plans and documents, in the manner which is most in tune with the technical requirements of the work to be constructed.
(c) Term for preparing the regulations or code.— Each agency shall have ninety (90) days, commencing on the effective date of this act, to prepare and adopt in final form, the regulations, or codes on certification procedures and technical specifications for design and construction, subject to the prior approval of the Planning Board and the Permit Management Office, when required.
