The first violation of §§ 311 and 312 of this title will be punished with a fine not to exceed five hundred dollars ($500), or six months imprisonment; and in the case of repetition of the offense, the violator shall be fined from five hundred ($500) to one thousand dollars ($1,000) or imprisoned from six months to one year. These penalties will be inflicted upon the proprietor of the publication, and if this be owned by an association or corporation, then the manager or president respectively, will suffer the penalty. In cases where the proprietor is unknown, the editor of the publication, the managing partner and the manager of the printing establishment where the publication has been edited, will be subsidiarily liable for the commission of the offense.
