Any individual, company or corporation or other entity that intends to beneficially utilize ground water must obtain an approved permit from the State Engineer before commencing construction, including test holes, on any ground water development.
In cases where a well has been drilled for some purpose other than to obtain water, and is then converted or utilized as a water well, a permit approved by the State Engineer must be obtained before the water from the well is beneficially used.
