Section 70:03:01:108 - Electric utility permit - Flagging and lighting requirements

During daylight hours, a vehicle transporting poles which extend more than four feet beyond the rear of the bed or body of the vehicle's trailer must meet the flagging requirements of § 70:03:01:14.

During nighttime hours, or at other times as required by SDCL 32-17-4, a vehicle transporting poles which extend more than four feet beyond the rear of the bed or body of the vehicle's trailer must have tail lights, clearance lights, and side marker lights in addition to the vehicle and trailer lights required in SDCL chapter 32-17. The additional lights must be attached to the poles. The additional lights required are as follows:

(1) Tail lights when lighted must emit a red light which is plainly visible from a distance of 1,000 feet to the rear and must be provided as follows:
(a) At least one tail light must be attached to the left rear corner of the poles if the end of the poles is two feet wide or less;
(b) At least two tail lights, one on each rear corner of the poles, must be attached to the poles if the end of the poles is wider than two feet;
(2) A rear clearance light must be attached to each side of the extreme rear corners of the poles and, when lighted, must emit a red light which is plainly visible from a distance of 500 feet to each side;
(3) If the distance between side lights on the vehicle exceeds 30 feet, side marker lights must be placed on the trailer or poles at or near the midpoint between the visible side lights and, when lighted, must emit an amber light which is plainly visible from a distance of 500 feet to each side.

The tail light may also function as the rear clearance light if it meets clearance light visibility requirements. If the trailer's stop lights or signal lights are not visible from the rear because of overhanging poles, additional stop and signal lights must be mounted at the rear end of the poles.
