Section Pari 806.35 - Qualifications for Occupational Licenses(a) Each applicant for an occupational license listed in Pari 806.01(a) shall: (1) Be able to perform those duties of the position for which the person is applying as are set forth in Pari 803 through Pari 805 and Pari 807;(2) Unless otherwise specified by these rules, be at least 18 years of age;(3) Except in the case of applicants for the position of greyhound judge under Pari 806.01(a) (8), be recommended to the commission for the occupational license by a majority of a board of judges noted in Pari 805; and(4) Except in the case of applicants for the position of greyhound judge under Pari 806.01(a) (8), be recommended to the commission for the occupational license by a judge selected by the commission under Pari 805.01(c);(b) An applicant for an occupational license listed in Pari 806.01(a) shall not, and if the applicant is a corporation, partnership or other form of association, its officers, directors, owners or trustees shall not: (1) Within the past 10 years have been convicted of or pleaded guilty to any felony as an adult that has not been annulled;(2) Within the past 10 years been convicted of or pleaded guilty to violation of any law relative to gaming or gambling or law relating to cruelty to animals which has not been annulled;(3) Within the past 2 years have been convicted of or pleaded guilty to any misdemeanor as an adult that has not been annulled which involves a controlled substance;(4) Currently be subject to the revocation or suspension of a license or occupational license relating to pari-mutuel wagering, dog racing or horse racing in this or any other jurisdiction;(5) Currently not be the holder of a license or occupational license relating to pari-mutuel wagering, dog racing or horse racing license issued in this or any other jurisdiction because such a license was voluntarily surrendered while a proceeding was pending against the applicant for alleged misconduct;(6) Currently be subject to exclusion from any premises at which the racing of horses or dogs or pari-mutuel wagering is held;(7) Currently be subject to a determination that the applicant is ineligible to engage in the racing or training of any horse or dog, or to engage in pari-mutuel wagering, as the result of misconduct in this or any other jurisdiction;(8) Have ever owned, operated or been associated in any way with any illegal gambling enterprise; or(9) If under the age of 18 years, be prohibited from performing the job functions performed by an occupational licensee in the field applied for by operation of the laws relating to the employment of minors, or any other state or federal law.N.H.
