Section Pari 805.03 - Decisions by the Board
(a) Decisions by the board shall be in accordance with the following in the following order:
(1) The laws of New Hampshire;
(2) These rules; and
(3) Special conditions of the racing meet or the race, if any have been set by the licensee.
(b) The video and photo images of the finish of a race, while of potential assistance to the board in its determination pursuant to Pari 805.05, shall not be conclusive of the board's determination.
(c) The board's determinations of the finish time of a race, the order of finish and the finish times of individual greyhounds shall stand, notwithstanding any malfunction of racing equipment, timing equipment or recording equipment.
(d) The decisions of the board shall supercede the orders of the officers of licensees.
(e) The decisions made, and any actions taken, by the board shall be:
(1) By a majority of the judges serving on the board;
(2) Signed by the majority board members making the decisions and taking the actions; and
(3) Reported to the commission as required by Pari 805.02(c) (3) and (4).
(f) Decisions other than those made by the board pursuant to Pari 805.02(a) (4) or Pari 805. (a) (5) shall be made by the commission.
(g) Any person or entity aggrieved by a decision of the board may challenge it through an adjudicative proceeding complying with Pari 201.
