Upon the issuance of a written complaint against any retail food establishment licensed by the Mississippi Department of Agriculture & Commerce for a violation of the law or the regulations, a copy of the complaint and any supporting documentation shall be sent to the accused by any of the methods set forth in Rule 4 of the Mississippi Rules of Civil Procedure or by certified mail. Within thirty (30) days after receipt of a copy of the complaint, the accused shall file a written answer with and/or submit supporting documentation to the Reviewing Officer. Failure to file an answer may constitute an admission of the allegation(s).
