Subsection 001-346-2-22 - Timely Correction for Critical Item ViolationA. Except as specified in Section 2, Subsection 24(B), a license holder shall at the time of inspection correct a critical violation of these Rules or implement corrective actions for a HACCP plan provision that is not in compliance with its critical limit.B. Considering the nature of the potential hazard involved and the complexity of the corrective action needed, the Department may agree to or specify a longer time frame, not to exceed ten calendar days after the inspection, for the license holder to correct critical violations of these Rules or HACCP plan deviations, provided food safety controls and preventive measures are in place and no health hazards exist consistent with 9 CFR 416, and 417.C. If a determination by the inspector that the corrective action cannot be completed within ten days, the inspector may request an extension be granted which must only be approved in writing by a supervisor.
