Subsection 001-346-1-7 - Documentation of Proposed Variance or Waiver and JustificationA. Before a variance from, or a waiver of, a requirement of these Rules is approved, the person requesting the variance or waiver must, at a minimum, provide the following information to the Department, which information must be retained in the Department's file on the establishment or processing plant: 1. A statement of the proposed variance or waiver of the Rule requirement citing relevant Rule part numbers;2. An analysis of how the potential public health hazards and nuisances addressed by the relevant Rule parts for which a variance of waiver is sought will be alternately addressed by the proposal; and3. A HACCP plan, if required, as specified under Section 10, Subsection 1(A), that includes the information specified under Section 10, Subsection 2, as it is relevant to the variance or waiver requested.
