Section 164.055 - Tobacco-free Environment(A) Tobacco and e-cigarette use is prohibited throughout the entire facility with no exceptions subject to M.G.L. c. 270, § 22 for acute care residential substance use disorder treatment centers. The prohibition shall include program-owned and/or leased vehicles, and personal vehicles when used to transport patients or residents. Such prohibition shall apply to everyone, including employees, patients, residents, consumers, contractors, and visitors.(B) The Licensed or Approved Provider may establish restricted exterior smoking and vaping areas away from main entrances to the building.
