§ 153. Transfer of property and land

(a) The Commonwealth and any of its agencies are hereby authorized to convey to the Corporation, at the latter’s request and under reasonable terms and conditions, without the need for holding a public auction, any property or interest therein deemed by the Corporation necessary or fitting for the attainment of its own ends. In such case in which the conveyance be of lands, the previous approval of the Governor shall be required so that said conveyance be valid.

(b) The Puerto Rico Land Administration is hereby authorized to convey to the Corporation, upon the previous approval of the Governor in regard to the conditions of the conveyance, including the adequate compensation, the lands or part thereof, that said Administration acquired by purchase from the Government of the United States of America where the Navy had installed a radio communications station, located South of the Martín Peña Channel between Muñoz Rivera Avenue and the Las Americas Expressway and North of Bolivia Street, in the Municipality of San Juan. The Administration shall not exercise said power without first taking into consideration the development of the Program of the Model City of San Juan.

(c) The Department of Transportation and Public Works is hereby likewise authorized to convey to the Corporation, upon the previous approval of the Governor in regard to the conditions of the conveyance, including the adequate compensation, the lands, or part thereof, of the Commonwealth located South of the Martín Peña Channel within the area of the New Center of San Juan.

(d) In every case concerning properties acquired by the Corporation, by conveyance made by the Commonwealth, or by any of its agencies, by virtue of the powers granted in this section and in accordance with the other conditions and requirements established in this chapter, the Corporation shall retain, at least, the nude property thereof, in any alienation carried out of such property in behalf of any person other than an agency of the Commonwealth of Puerto Rico, for the purposes of carrying out the public aims embodied in this chapter.

The Board of Directors of the Puerto Rico Land Administration may exempt any project it deems advisable from this provision, as concerns the development of the New Center of San Juan. Its determination will be based on the properly grounded recommendations of the Board of Directors of the New Center Corporation of San Juan.

The Board of Directors of the Puerto Rico Land Administration will promulgate the necessary regulations to comply with the objectives of this subsection.

(e) Nothing provided in this section shall be construed as authorizing the conveyance to the Corporation of property devoted to other purposes by expressed legislative action, or of property subject to restrictions in connection with its alienation and should said property be conveyed, said transaction would damage contractual obligations assumed by the transferring agency.

(f) There is hereby imposed on the Executive Director of the Corporation the duty of certifying to the House of Representatives and to the Senate of Puerto Rico, by filing in the Office of the Secretary of both Bodies, the following data on each conveyance transaction, including the lease of any property described by this section: size and location of the parcel of land; price and method of acquisition by the transferring agency; market value in accordance with the appraisal of the Department of the Treasury; value determined for the conveyance or lease; other important conditions of the conveyance; person who will acquire the property; and purpose to which said property has and will be devoted. The Executive Director of the Corporation shall likewise have the duty of certifying to the Legislature, in the form above provided, each plan, rule or regulation in regard to the planning of the New Center of San Juan adopted by the Corporation in accordance with the powers granted by § 144 of this title.
