§ 228a. Authorization

This chapter hereby empowers and authorizes the Government of Puerto Rico, as well as any of its agencies, departments, instrumentalities, political subdivisions, municipalities and public corporations to execute and enter into agreements with any person, whether natural or juridical, to confer through sale the naming rights over any public property, whether real or personal, tangible or intangible, as well as over projects and events, by means of the exclusive inclusion of the name or brand of the sponsor or enterprise to which said rights are conferred.

Provided the public interest so warrant[s] it, in the judgment of the government entity concerned, naming rights may be conferred over public properties in order to replace the names of public properties, to attach a trade name or brand to the existing name of a public property, or to provide a trade name or brand for a new public property which has not been previously named.

The powers and the authorization contained herein shall be subject to the conditions and procedures established under this chapter, as well as to the regulations to be adopted in order to implement the same.

The head of the government entity that owns the public property over which any naming rights are being conferred shall have all the powers and authorities necessary to be able to enter into this kind of agreement and to execute documents as necessary to perfect the same.
