§ 206i. Certificates

As of the effective date of the resolution designating a school zone for a respective school, the Permit Management Office, when requested to do so, shall have the obligation to issue certificates for those uses, buildings and structures that were legally established and that do not conform with this chapter and the regulations adopted thereunder.

These certificates shall clearly state the nature and extent of the nonconformity as well as all those areas in regard to which an existing building, structure or property does not conform with the regulations adopted and promulgated.

Persons who obtain a certification of legal non-conforming use may request and obtain an operating permit for said use for a term of two (2) years as of the date of approval of the resolution delimiting the school zone for a respective school. Depending on the particular circumstances of the case, the Planning Board may establish a procedure to consider longer periods of time or to authorize a change or modification in the operation that will convert its use into a conforming use.
