§ 206d. Designation and demarcation; prior evaluation

Pursuant to § 206a of this title, once the Governor approves the School Zone Regulations, the Planning Board shall evaluate the situation of schools in Puerto Rico in the light of the public policy objectives of this chapter. This evaluation may be performed by initiative of the Planning Board or by a request of the Department of Education or the superintendent of schools and, in the case of private schools, the authorized representative of the institution.

By request of the school authorities or the parent-teachers’ council concerned, the Planning Board shall proceed to identify, case by case, those school areas that require priority attention in view of the risk to the students’ and teachers’ safety and the seriousness of the harmful effects to the school environment caused by the activities developed in the school surroundings. Once they are identified, the Planning Board may designate and demarcate the school zone for the particular school, through a resolution approved in accordance with the procedures established in § 206b of this title. Prior to such designation and demarcation, the Planning Board shall hold public hearings after notifying the owners or operators of businesses and residents of homes located on the possible limits of the zone.
