If after the resolution of the court on the certificate of death has become final and binding, the person presents himself or his existence is otherwise proven, a request to void said resolution may be presented, and through an ordinary civil procedure he may:
(a) Recover his estate in whatever state it is, and shall be entitled to the price for which it was sold, or to that property which was acquired with said price. He shall only be entitled to receive the income, profits or interest from the date he presents himself or his existence is made known.
(b) After the prior appearance of the Office of the Prosecutor, the court shall issue the corresponding resolution leaving the death certificate of the person so certified without effect and directing the Secretary of Health to annul the death certificate issued and revalidate the birth certificate. The Secretary of Health shall establish the pertinent rules and procedures to such effect.
