§ 4004. Powers and duties of the Board

The Board shall have the following powers and duties:

(a) Adopt regulations for its operation, compliance of its duties and procedures needed to transact its business as provided in §§ 2101 et seq. of Title 3, known as the “Uniform Administrative Procedures Act”. These regulations shall be approved within the term of six (6) months as of the date the Board is constituted. The Board may also promulgate other regulations that are necessary for the implementation of this chapter;

(b) prepare and administer certification examinations to those who aspire to practice nuclear medicine technology. The examination shall be offered every six (6) months at the place and time determined by the Board;

(c) establish in its regulations the fees to be charged for taking the examinations, for the granting and renewal of the license and others;

(d) authorize the exercise of the practice of nuclear medicine technology in Puerto Rico by granting a license to those persons who meet the requirements and conditions established in this chapter;

(e) be able to certify as “Licensed Technologist in Nuclear Medicine” those persons who before the approval of this act had been certified by the “NMTCB” or any other foreign certification reasonably equivalent to the requirements set forth in this chapter. The Board has the authority to establish the parameters to be followed in the certification examinations administered by the same;

(f) issue, renew, suspend, revoke or deny licenses on the grounds consigned in this chapter;

(g) investigate the violations of this chapter, on its own initiative, or by a complaint filed before said body by [an] injured person or by a duly licensed professional in the field of nuclear medicine technology;

(h) maintain a public register with a true and exact list of those persons authorized to practice nuclear medicine technology, their license number, work and residential address and telephone number. The Board shall also maintain a file of the licenses granted, denied, temporarily suspended or permanently revoked [as] well as the temporary licenses;

(i) submit to the Governor through the Secretary of Health, an annual report of its achievements, including the number of licenses issued, denied or renewed as well as any other information requested by the Governor;

(j) prepare and submit to the Secretary of Health, a report of income and expenses for each fiscal year;

(k) hold those meetings and sessions needed to conduct its operations, upon a summons by the Chairperson or at the request of two (2) or more members of the Board;

(l) maintain a book of minutes of all proceedings and note in the pertinent books its resolutions and actions, and

(m) adopt an official seal for the transaction of its business.
