The surviving spouse and the dependant or permanently disabled minor children of the public employees who are entitled to the benefits of this chapter shall be entitled to receive from the agency or entity concerned, the total of the net salary as [a] public employee for a term not greater than twelve (12) months in addition to the month on which the service member died in the line of duty, was declared missing in action, or captured as a prisoner of war.
The widow of a fallen, missing or captured service member in active service, or tutor representing the minor children, dependants or permanently disabled children of such service member shall furnish to the pertaining agency, municipality or dependency, as the case may be, the certification of status issued by the United States Armed Forces or any pertinent federal or state agency, including the State Guard, to receive the benefits set forth in this chapter.
