§ 4226. When emphyteuticary disturbed in right may claim indemnity

If the emphyteuticary should be disturbed in his right by a third party who disputes the legal ownership or the validity of the emphyteusis, he cannot claim the corresponding indemnity from the legal owner if he does not summon him for the eviction, in accordance with the provisions of section 3838 of this title.
