§ 2342. Definitions

The following terms and phrases shall have the meaning expressed hereinbelow:

(a) Department.— Means the Department of Consumer Affairs, created by §§ 341 et seq. of Title 3.

(b) Discount market.— Means any event which involves a series of sales, which by their number and space, are characteristic of a business where:

(1) Two (2) or more persons offer personal objects or articles for sale or barter;

(2) rent, a commission or a fee is charged for the privilege of exhibiting objects or articles for sale or barter;

(3) buyers or customers are charged a rent, commission or fee for entrance to the premises where personal objects or articles are offered for sale or barter;

(4) merchandise is offered or shown for sale or barter, even though it may not be immediately, regardless of the number of persons offering personal objects or articles for sale or barter or without any rent, commission or fee being charged.

(c) Operator.— Means any person, partnership, company, organization or corporation controlling or administering a discount market in which any personal object or article is bartered, sold or offered.

(d) Seller.— Means any vendor, person, association, organization or corporation that barters, sells or offers any article, object or product at a discount market.
