§ 2405. Risks existing within property

It is the responsibility of the owners of lands adjacent to the highway to eliminate by themselves any risk existing within their property that threatens the safety of the highway, except those risks cause or created by nature. In all events, if the owner does not eliminate the danger, the Department has the authority to enter the property, carry out the work and collect from the owner the expenses incurred in repairing the damages and correcting the situation caused by his negligence or carelessness.
