§ 786. Penalties

Any person who violates the terms of any contract entered into pursuant to § 782 of this title, or who violates any provision of the regulations promulgated by the Secretary of Agriculture or the Secretary of Health, shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine of not less than one hundred dollars ($100) nor more than five hundred dollars ($500) for the first offense; and for each subsequent violation, by a fine of not less than two hundred dollars ($200) nor more than five hundred dollars ($500), or by imprisonment in jail for a term of not less than thirty (30) days nor more than three months, or by both penalties, in the discretion of the court.

After holding the corresponding administrative hearing giving the person concerned a chance to be heard, the Secretary of Agriculture is hereby empowered to impose administrative fines up to a sum of one hundred dollars ($100) for the first time and up to five hundred dollars ($500) for any subsequent violation, when it is found that the provisions of §§ 781—786 of this title or of the regulations promulgated hereunder have not been complied with.
