Section 172.5 - Inapplicability of statutes governing unlawful sale of intoxicating liquor to club near University of California at BerkeleyThe provisions of Sections 172 and 172a of this code shall not apply to the sale or exposing or offering for sale of alcoholic beverages by a licensee under the Alcoholic Beverage Control Act within the premises occupied by any bona fide club which is situated within one mile of the grounds belonging to the University of California at Berkeley, if the club meets all of the following requirements:
(a) The membership in the club shall be limited to male American citizens over the age of 21 years.(b) The club shall have been organized and have existed in the City of Berkeley for not less than 35 years continuously.(c) The club shall have a bona fide membership of not less than 500 members.(d) The premises occupied by the club are owned by the club, or by a corporation, at least 75 percent of whose capital stock is owned by the club, and have a value of not less than one hundred thousand dollars ($100,000).Amended by Stats. 1967, Ch. 138.
