The Probate Court is responsible for all aspects of eminent domain cases.
If there are no objections to the award filed, the Probate Court will continue to be responsible for the case through its completion.
If there is an objection to the award filed, County Court at Law 1 or 2 will be responsible for the case through its completion. After an objection to the award is filed, the procedure for obtaining a setting is similar to other civil cases under these Rules.
Files for these cases are located in the probate section of the County Clerk's office.
