Subject to law, the Superior Court shall be deemed always open for the purpose of filing any proper paper, of issuing and returning process, and of making motions and orders. The clerk's office with the clerk or deputy or an assistant in attendance shall be open during business hours on all days except Saturdays, Sundays, and legal holidays.

This rule is patterned upon its federal counterpart and reflects existing Rhode Island practice. Under G.L. 1956 (1969 Reenactment), § 8-7-10 the Superior Court is deemed always open but no business shall be transacted on Sundays or legal holidays which have been established by the legislature. See G.L. 1956 (1968 Reenactment), § 25-1-1 (Supp.1970). See also R.P. 2.1, Rules of Practice of the Superior Court, governing assignment of cases on certain days that are not "legal holidays." The proposed rule is also similar to subdivisions (a) and (c) of Rule 77, R.I.Super.R.Civ.P.
