Rule 11-317 - FAILED CONDITIONAL CONSENT(a)Notice If, at any time before the court issues an order for adoption of the child, a party becomes aware that a condition of consent to the guardianship may not be fulfilled, the party promptly shall: (1) file a notice with the juvenile court;(2) notify all other parties; and(3) if consent was received from a person who is not a party, give notice to that person.(b)Hearing The juvenile court shall hold a hearing within 30 days after the filing of the notice. (c)Order If the court finds that a condition to consent cannot be fulfilled and the party or person whose condition cannot be fulfilled does not enter into a new consent, the juvenile court shall: (1) set aside the guardianship order;(2) set the case in for a prompt trial on the merits of the guardianship petition; and(3) reopen the CINA case for review pursuant to Code, Courts Article, § 3-823.Md.
