Section 1-2 - Definitions

(a) "Adult Member" is a person 18 years of age or older in a household that is applying for or receiving food stamps.

(b) "AFDC" is the Aid to Families with Dependent Children Program which is financial assistance, for caretaker relatives with dependent children in need, as provided for by Title IV-A of the Social Security Act of 1935 as amended.

(c) "AFDC-UP" is the Aid to Families with Dependent Children Unemployed Parent Program which is financial assistance for intact families with dependent children who are in need because of the unemployment of the parent who was the principal wage earner.

(d) "Agency Error (AG)" is an incorrect action or failure to take action by a DFS worker.

(e) "Alien" see "Sponsored Alien".

(f) "Assistance Unit" is the different units of people defined byeach program to receive benefits.

(g) "BEERS" stands for Bendex earnings from wages and self-employment reported on tax returns and is a computer match with the DFS Eligibility Payment and Information System.

(h) "Budget Month" is the calendar month in which the income is received by the applicant or recipient. It is the same as the payment month for prospective budgeting and is the second month prior to the payment month for retrospective budgeting.

(i) "CARC" stands for Case Record Control on Epics and means the case transfer from office to office or worker to worker.

(j) "Case File" is a folder containing documents relating to an assistance unit or household.

(k) "Cash" is currency in the form of bills, coins, checks and/or money orders.

(l) "Categorical Eligibility" is a term used to designate food stamps eligibility by virtue of receiving AFDC, AFDC-UP and/or SSI.

(m) "CC" stands for the child care program which provides direct care and services to children from birth through age 12 and to developmentally delayed or handicapped children from age 13 through 18.

(n) "CHINS" stands for children in need of supervision.

(o) "Claim" is a form or EPICS record that formalizes and documents an overpayment and also may refer to the total amount due.

(p) "Client Error (CL)" is a misunderstanding or unintended error on the part of the assistance unit (household) or provider.

(q) "CO-DFS" is the central office of the Department of Family Services located in Cheyenne, Wyoming.

(r) "Collateral Contact" is a verbal or written confirmation of a household's or provider's circumstances by a knowledgeable source.

(s) "Court Limits" are the dollar amounts of the claim that determine the court of appropriate jurisdiction per Wyoming Statute. The courts utilized by DFS are as follows:

  • (i) small claims court;
  • (ii) county court;
  • (iii) district court.

(t) "Court of Appropriate Jurisdiction" shall be either a district, county or small claims court as determined by the amount of the overpayment, the circumstances of the case and the advice of legal counsel.

(u) "DFS" stands for the Department of Family Services inclusive of the state and field offices.

(v) "Date of Referral" is the date of completion of the Case Information Document and/or the date the recoupment case is entered on EPICS.

(w) "Default" is when the assistance unit fails to make the payment or pay the full amount agreed to in the Installment Contract during any given month.

(x) "Delinquent Claim" is an overpayment case with:

  • (i) no response to two notices; or
  • (ii) a signed Installment Contract and no payment received within the prior 60 days; or
  • (iii) a signed Installment Contract and a payment for an amount less than the stipulated figure.

(y) "DH" stands for the Department of Health.

(z) "Document" (verb) means the act of entering in the case or provider file the circumstances and facts obtained through verification.

(aa) "Documentary Evidence" is a written confirmation by a knowledgeable source of the assistance unit's (household's) or provider's circumstances.

(bb) "Documentary Evidence Error" is the written confirmation by a knowledgeable source of the assistance unit's (household's) or provider's circumstances.

(cc) "EA" stands for the Emergency Assistance Program which provides financial assistance to families.

(dd) "EAS" stands for Economic Assistance Specialist.

(ee) "E&T" stands for the Food Stamps Employment and Training Program.

(ff) "Eligible" means the assistance unit is entitled to receive assistance because he/she meets all of the specified conditions or factors for the program(s).

(gg) "EPICS" stands for the Eligibility Payment Information Computer System.

(hh) "Error" is the receipt by an assistance unit (household) or provider of benefits or payments over the amount of entitlement.

(ii) "Exclude" means to set aside or free from policy or limits. Not counted.

(jj) "FMAP" stands for the Federal Medical Assistance Program matching percentage set for each federal fiscal year.

(kk) "FNS" stands for The United States Department of Agriculture's Food and Nutrition Service which administers the Food Stamp Program.

(ll) "FO-DFS" stands for the Field Office of the Department of Family Services.

(mm) "Food Stamp Coupon" is the form provided for the purchase of eligible food or food items; also a negotiable instrument used to repay Food Stamp overpayments.

(nn) "FS" stands for the Food Stamp Program which is in-kind assistance used to trade for food by the Food and Nutrition Service.

(oo) "GA" stands for the General Assistance Program which provides financial assistance to disabled and aged individuals.

(pp) "Gross Income" is the total amount of money a person is entitled to receive prior to any deductions.

(qq) "Hit" is the discrepancy found between EPICS data and the interface with records of other agencies such as the Internal Revenue Service, Employment Security wages and Unemployment Compensation, Social Security Title II (RSDI) and Title XVI (SSI), state retirement, Worker's Compensation, etc.

(rr) "Household" see "Assistance Unit".

(ss) "IA" stands for the Interim Assistance loan made to applicants of SSI.

(tt) "IFG" stands for Individual Family Grant.

(uu) "Inadvertent Household Error" see "Client Error".

(vv) "Initial Month" is the first month the overpayment occurred.

(ww) "Intentional Program Violation" (IPV or Fraud (FR)) is determined by either a Food Stamp Disqualification Hearing or by a court of appropriate jurisdiction. IPV also exists when an individual signs a waiver of a disqualification hearing or a consent agreement due to deferred adjudication.

(xx) "IRS" stands for the Internal Revenue Service.

(yy) "IV-E" stands for foster care and subsidized adoption funded by Title IV-E of the Social Security Act.

(zz) "LIEAP" is the Low Income Energy Assistance Program.

(aaa) "Lump Sum" is all or partial payment on a claim prior to negotiation or a regular monthly payment.

(bbb) "Mandatory Living Expenses" are the expenses an assistance unit must pay in order to live.

(ccc) "ME" stands for Medicaid or medical assistance under Title XIX of the Social Security Act of 1935 as amended.

(ddd) "MMP" stands for the Minimum Medical Program which provides vendor payments for specified medical expenses not covered by Medicaid under Title XIX of the Social Security Act.

(eee) "Notify" is to make facts or suspicions about eligibility or benefit level known to applicants or recipients verbally or in writing.

(fff) "Offset" is to reduce the amount of the overpayment by the amount of an existing underpayment.

(ggg) "ORP" stands for the Overpayment Recovery Program in the Department of Family Services.

(hhh) "Overpayment" is the financial or medical assistance benefits received by or for an assistance unit (household) for a payment month which exceeds the amount for which the unit was eligible.

(iii) "PAIS" stands for the Payee Analysis and Intercept System which records the discrepancies found in comparisons of income and resources reported by the client and records of other agencies such as Internal Revenue Service, Employment Security wages and Unemployment Compensation, Social Security Title II (RSDI) and Title XVI (SSI), State Retirement, Worker's Compensation, Motor Vehicles, etc.

(jjj) "Payment Month" is the calendar month for which the assistance is issued.

(kkk) "Potential" is a reason to believe a fact may be true for a future period of time, which cannot currently be proven.

(lll) "Programs" or types of benefits for which ORP attempts recovery of overpayment are:

  • (i) AFDC - Aid to Families with Dependent Children;
  • (ii) AFDC-UP - Aid to Families with Dependent ChildrenUnemployed Parent;
  • (iii) CC - Child Care;
  • (iv) DA - Disaster Assistance - Family Grant Program;
  • (v) EA - Emergency Assistance;
  • (vi) FS - Food Stamps;
  • (vii) GA - General Assistance;
  • (viii) IA - Interim Assistance (eligibility overpayments);
  • (ix) LIEAP - Low Income Energy Assistance Program;
  • (x) ME - Medicaid under Title XIX (all coverage groups);
  • (xi) MMP - Minimum Medical Program;
  • (xii) RE - Refugee Assistance;
  • (xiii) SS - Social Services under Title XX;
  • (xiv) SHP - State Hospital Placement under State Licensed Sheltered Care;
  • (xv) SLSC - State Licensed Sheltered Care;
  • (xvi) TEFAP - The Emergency Food Assistance Program;
  • (xvii) WOW-SS - WOW Supportive Services; and
  • (xviii) Any other program assigned to DFS-ORP.

(mmm) "Provider" is an individual, business or agency from whom DFS purchases services or goods on behalf of a recipient or assistance unit (household).

(nnn) "Provider File" is a folder containing documents relating to a provider.

(ooo) "Public Assistance" is financial assistance in the form of a grant, vendor payment, food stamps or a payment under the minimum medical program.

(ppp) "RA" stands for the Refugee Assistance Program which provides financial assistance to refugees in the United States of America.

(qqq) "Recipient" is a person who receives benefits from and/or is determined eligible for a program.

(rrr) "Round" is to convert one to 49 cents down to the nearest whole dollar and to convert 50 to 99 cents up to the nearest whole dollar.

(sss) "SHP" stands for the State Hospital Placement Program which provides payment of nursing home services for people who have previously been in the State Hospital.

(ttt) "SLSC" stands for the State Licensed Sheltered Care Program which provides payment of nursing home services for specified individuals not eligible for Medicaid.

(uuu) "Sponsor" is any person or any public or private organization that has executed an affidavit of support or similar agreement for an alien as a condition of entry into the United States.

(vvv) "Sponsored Alien" is a person lawfully admitted for permanent residence into the United States using a sponsor agreement.

(www) "SS" stands for the Social Services Programs which provide client and provider purchased services.

(xxx) "Suspend" is to stop collection efforts until the client reapplies or the whereabouts become known.

(yyy) "TEFAP" stands for the The Emergency Food Assistance Program which provides commodities to low income individuals.

(zzz) "Terminate" is to end or write off an unpaid claim due to a bankruptcy order, death of all household members when no estate exists or an administrative reason.

(aaaa) "Underpayment" is the additional or supplemental payment of benefits paid to or for an assistance unit for a payment month to assure correct entitlement.

(bbbb) "Verify" is to check, confirm or establish whether a statement or condition is true or accurate by obtaining a copy, viewing a copy or obtaining a verbal description of the content of the evidence.

(cccc) "Waiver of Food Stamp Disqualification" is a written consent to disqualification from the Food Stamp Program without a hearing which includes a declaration of whether the recipient admits to the facts presented by the Agency.

(dddd) "WOW" stands for Wyoming Opportunities for Work and is an education, training and employment program for recipients of Aid to Families with Dependent Children (AFDC) and Aid to Families with Dependent Children - Unemployed Parent Program (AFDC-UP).
