Section 5-5 - Reservoir Enlargement Applications

a. Reservoir enlargement applications should be submitted on Form S.W. 3 (the same form and procedure as used for original reservoir applications). The name of the reservoir should indicate the enlargement of the reservoir involved; for example: "The Enlargement of the Model Reservoir." Underneath the name of the reservoir, show the permit number of the original reservoir to be enlarged and any existing valid enlargements.

b. Previous instructions given for reservoir applications and original water right applications would apply, with the following exceptions:

  • (1) ITEM 3(a) -- For the "Reservoir Capacity Breakdown by Uses", provide the capacities (in acre-feet) for the enlargement of the reservoir as follows:
    • (a) Irrigation and/or Other Uses-Capacity of the enlargement of the reservoir. Specify capacity allocated to each use.
    • (b) Flood Control-Capacity between principal spillway and emergency spillway.

      NOTE: The capacity table on the map should clearly show the capacity of the reservoir at the original high-water line elevation. It should also show the enlargement capacity between the high-water line of the original reservoir and the high-water line elevation of the reservoir enlargement. Be sure the capacity figures shown on the map agree with those shown on the application. (See sample map on page 65.)

  • (2) ITEM 3(b) -- "The area of the high-water line of the reservoir . . ... ." -- Give the area of the high-water line (in acres) of the enlargement of the reservoir.
  • (3) ITEM 3(c) -- "The total available capacity of the reservoir is , , . ." -- Show the total capcity of the reservoir as enlarged.
  • (4) ITEM 3(d) - "If enlargement, the capacity of the enlargement is . . . ,." -- Show the additional storage capacity gained by physically enlarging the reservoir.
  • (5) ITEMS 8(a) and 8(b) -- Describe the work contemplated under the proposed enlargement only.
  • (6) On the second page of the application form, insert a "Con-sent to Enlarge" which has been signed by the sole owner or owners of the reservoir. The format for the "Consent to Enlarge" on page 112 can be used to serve as a guide. The granting of a permit by the State Engineer to enlarge a reservoir does not grant the permittee any right to the use of the property of another, but is merely a permit to appropriate the water. If it is not possible to secure the consent of the sole owner or owners Of the reservoir to the proposed enlargement, this fact should be set forth in the application.
