Section 41 - 138, Wyoming Statutes 1957, as amended by Section 6, Chapter 213, Session Laws of Wyoming 1969, provides that an application must be submitted and a permit secured from the State Engineer before any ground water diversion (including test holes for a larger well) is constructed. If any well constructed for any other purpose is found to be suitable for the withdrawal of ground water, a permit must be obtained before the water is utilized.
