Section 42-8-2 - Application and Enforcement2.1. This rule applies to all persons, employers, and employees governed or otherwise within the purview of the Minimum Wage and Maximum Hours Standards for Employees Act, W. Va. Code § 21-5C-1et seq.2.2. Pursuant to W. Va. Code § 21-5C-1(e), the provisions of this rule relating to maximum hours and overtime compensation are not enforceable against or applicable to any individual, partnership, association, corporation, person or group of persons, or similar unit if 80% of the persons employed by him or her are subject to any federal act relating to maximum hours and overtime compensation.2.3. Enforcement. The enforcement of this rule is vested in the West Virginia Division of Labor.
