Current through Register Vol. XLI, No. 50, December 13, 2024
Section 126-85-34 - Afterschool Snacks Under National School Lunch Program
34.1. Snacks that meet USDA requirements are eligible for reimbursement. Only one snack per day may be claimed for a student who is:
34.1.1. enrolled in the educational program of the SFA;
34.1.2. in attendance at the time of the meal service; and
34.1.3. meets age criteria [pre-kindergarten through 18, (19 if enrolled)].
34.2. The type of reimbursement claimed for snacks (free, reduced, or paid) may be determined by individual student eligibility or area eligibility:
34.2.1. Individual student eligibility for free or reduced price meal benefits is based on the completion and approval of the Free and Reduced Price Meal Application or identification of the student through the Direct Certification process if the student does not live in a 50% plus needy area (Traditional Snack Program under NSLP);
34.2.2. Area eligibility claiming of students at the free rate of reimbursement is based on the student's participation in a program located in an attendance area defined as 50% plus needy (At-Risk Snack Program under NSLP);
34.3. Second snacks consumed by students should be listed as non-reimbursable snacks.
34.4. Snack Programs under NSLP (NSLP-Snack) must be located in a school district that operates the NSLP and must contain regularly scheduled educational or enrichment activities in a supervised environment.
34.5 In order to be reimbursed, snacks must contain at least two different components of the following four:

34.5.2. a serving of meat or meat alternate; nuts and seeds and their butters listed in program guidance are nutritionally comparable to meat or other meat alternates based on available nutritional data. Acorns, chestnuts, and coconuts are excluded and shall not be used as meat alternates due to their low protein content. Nuts or seed meals or flours shall not be used as a meat alternate except as defined in 7 CFR Section 210 Regulations, Appendix A. Alternate Foods for Meals; for children ages 3-5, the serving size is 1/2 ounce; for children 6-18, the serving size is one ounce.
34.5.3. a serving of vegetable(s) or fruit(s) or full-strength vegetable or fruit juice; or an equivalent quantity of any combination of these foods. Juice may not be served when milk is served as the only other component; for children ages 3-5, the serving size is 1/2 cup; for children ages 6-18, the serving size is 3/4 cup.
34.5.4. a serving of whole grain or enriched bread; or an equivalent serving of cornbread, biscuits, rolls, muffins, etc., made with whole-grain or enriched meat or flour; or a serving of cooked whole-grain or enriched pasta or noodle products such as macaroni, or cereal grains such as rice, bulgur, or corn grits; or an equivalent quantity of any combination of these foods. For children ages 3-5, the serving size is 1/2 slice bread, 1/3 cup cold cereal, or 1/4 cup hot cereal; for children ages 6-18, the serving size is 1 slice bread, 3/4 cup cold cereal, or 1/2 cup hot cereal.
