Section 388-891A-0250 - What is a fair hearing?(1) A fair hearing is a review process outlined under the Administrative Procedure Act, chapter 34.05 RCW and chapter 388-02 WAC that is conducted by an administrative law judge who works for the office of administrative hearings.(2) During a fair hearing, both you and DVR may present information, witnesses, and documents to support your position.(3) You may ask someone to represent you, such as an attorney, friend, relative, representative from the client assistance program, or someone else you choose.(4) No DSHS employee may represent you in an administrative hearing challenging a DVR decision.(5) The administrative law judge makes a decision after they hear all of the information presented and review any documents submitted and relevant laws and regulations.Wash.
