The following procedures apply to the submission of a permit amendment application:
(1) Upon submission of a permit amendment application to the department, the applicant shall submit a copy of the application to the office of the register of deeds in the county in which the affected land is located. Proof of submission to the register of deeds shall be transmitted to the department;(2) To facilitate agency review of a permit amendment application, the applicant may submit copies of the amendment application by certified mail to the following agencies at the same time the application is submitted to the department: (a) The department of game, fish and parks;(b) The department of agriculture;(c) The department of education and cultural affairs;(d) The U.S. forest service, if lands under its jurisdiction are included in the amendment;(e) The local conservation district;(f) The U.S. bureau of land management, if lands under its jurisdiction are included in the amendment; and(g) The department of health. A copy of the return receipts shall be submitted to the department.
(3) Within 10 days after the submission of a permit amendment application, the department shall notify individuals on the interested persons mailing list and the county commission of a county containing affected land.S.D. Admin. R. 74:29:03:05
