Section 74:29:03:04 - Additional surety required

If a permit amendment application or technical revision causes the cost of reclamation to exceed the amount of the reclamation surety posted for the existing permit, the operator must submit a surety in an amount equal to the additional cost of reclamation before board approval of the amendment application or approval by the department of the technical revision.
