Section 70:03:01:32 - Extended period permit - Farm implement dealers and commercial farm machinery operators

A permit-issuing authority may issue an extended period permit that allows the movement of an oversize but not overweight permit vehicle consisting of a vehicle hauling or pulling up to two farm implements by a commercial farm machinery operator, or by or for a farm implement dealer. A vehicle consisting of a single unit or a combination of two units may move on the state trunk highway system. A vehicle combination consisting of three units may move on the state highway system, but not on the interstate highway system. The permit shall be assigned to the permit vehicle's power unit. An assigned permit may be used to road-deliver a self-propelled farm implement.

The extended period permit is valid for the movement of an overwidth permit vehicle up to 16 feet wide on the interstate highway system and up to 20 feet wide on the state highway system. The maximum length of the vehicle may not exceed 100 feet. The maximum length of a farm implement in a three unit combination is 45 feet. The height of the permit vehicle may not exceed 18 feet. A permit vehicle that exceeds these size limits requires a single-trip permit.

Single and two unit vehicles may move during daylight hours. Three unit vehicle combinations may move only from sunrise to sunset.

If a permit vehicle consists of one or more units not equipped with operating brakes on all wheels, the permit vehicle's power unit must be a farm tractor or its equivalent. If the permit vehicle's power unit is not a farm tractor or its equivalent, the permit vehicle may not exceed a speed of 25 miles per hour or additional limitations as listed by the implement tire manufacturer or it must be demonstrable, upon request by a law enforcement officer, that it meets the brake performance requirements of SDCL subdivision 32-18-8(3). The permit vehicle's operator shall be responsible for any damages caused during a brake performance demonstration.

A permit vehicle consisting of three units may not travel in excess of 25 miles per hour and the rearmost implement shall display red flags on the extremities.

A permit vehicle hauling farm implements under the authority of this permit is in compliance with the maximum axle or tire weight limits set by SDCL 32-22-16 or 32-22-21 if the following conditions are met:

(1) The total gross weight is within the limits set by SDCL 32-22-16;
(2) The weight on axles and tires is not more than 10 percent over the maximum axle and tire weight limits set by SDCL 32-22-16 or 32-22-21; and
(3) The load is shifted on the permit vehicle so that the maximum weight limits on axles and tires are met. Failure to shift weight to a legal condition allows for enforcement action to be taken for violation of legal weight limits.
