A permit-issuing authority may, upon declaration of an emergency by the Governor pursuant to SDCL chapter 34-48 A, issue an extended period permit that allows movement on state trunk highways of a vehicle that consists of one or more units and exceeds the size limits set in SDCL chapter 32-22. The Department of Public Safety, upon consultation with the Department of Transportation and the Office of the Governor, may establish operational limits of a vehicle of one or more units of sufficient size to transport commodities to alleviate the public emergency. The permit-issuing authority may allow the movement of the vehicle any time of the day. The duration of the permit issued shall only be for the amount of time necessary to alleviate the public emergency. Any permit issued under this rule is void upon expiration of the declared emergency. No permit may be issued under this rule for movement of a load that could be readily reduced in size or weight, except as provided by this chapter. No permit may be issued under this rule for movement of a load that exceeds any weight limitation provided in SDCL chapter 32-22. This permit is only valid for movement of commodities in direct support or relief of the public emergency.
Before moving under the authority of this permit, the permit holder shall inspect the proposed route of travel to verify that no horizontal or vertical clearance limitations exist that prohibit the proposed move. If the proposed route of travel cannot be inspected, the permit holder shall contact the permit center to assure that no prohibitive clearance limitations exist.
The permit-issuing authority may place limitations on this permit as to route of travel and time of movement. The permit-issuing authority may specify additional requirements on this permit as to signing, flagging, lighting, escort, special traffic control, and any other operational or safety requirement.
Each permit shall be issued at the discretion of the permit-issuing authority. An application for a permit does not assure permit approval. The permit-issuing authority in exercising its discretion, shall be guided by the provisions of this chapter.
Any permit issued under this rule shall be issued at no cost.
