All applications for license must be filed with the executive secretary who may issue the license, issue a conditional license which states the specified requirement and the time period that a person has to comply with the requirement, hold the application for further investigation, or deny it. If the license is denied, the applicant may appeal the denial in writing to the commission within 10 days after being notified of the denial. The appeal is a contested case pursuant to SDCL chapter 1-20.
A conditional license expires at the conclusion of the set time period if the specified requirement is not met. A person who supplies false information on a license application is subject to a fine or suspension or both. A license issued based on false information may be revoked.
