Section 165:35-43-6 - Determining assessment fees

(a) In cases initiated on the Public Utility Docket to meet requirements of this subsection, fees shall be assessed upon a motion of PUD Staff or upon motion of the Attorney General.

(b) The Commission shall determine the estimated costs of PUD and the Attorney General required to process, analyze and review filed information as required by this subsection. These estimated costs shall be the basis of the fee assessed on a TOU subject to this Subchapter.

(c) After notice to the TOU to be assessed and hearing, the Commission shall issue an order which shall include the following:

(1) Whether or not the TOU will be assessed fee(s);

(2) The amount of the fee(s) to be assessed; and

(3) The date payment(s) shall be paid.
