N.Y. Comp. Codes R. & Regs. tit. 9 § 4.93
WHEREAS, Beginning on April 3, 1987, a storm system with accompanying rain and strong winds caused severe flooding which resulted in death, injury and personal hardship, as well as damage to residential and commercial property, interruption of essential services, destruction of flood protection structures and major disruption of the New York State Thruway and other vital transportation systems; and
WHEREAS, The effects of the severe storm system continue to pose a threat of further damage and disruption of essential services:
NOW, THEREFORE, I, Mario M. Cuomo, Governor of the State of New York, do hereby find that a disaster has occurred to which the affected local governments are unable to adequately respond, and, therefore, I hereby declare, pursuant to the authority vested in me by the Constitution, the laws of the State of New York and section 28 of article 2-B of the Executive Law, a disaster emergency, effective April 3, 1987, within the affected areas of Schoharie, Montgomery and Ulster Counties and contiguous areas.
Further, pursuant to section 29 of article 2-B of the New York State Executive Law, I direct the implementation of the State Disaster Preparedness Plan and authorize, effective April 3, 1987, all appropriate State agencies to take such actions as may be necessary to assist the affected areas in repairing, restoring and protecting private and public facilities and to provide such other emergency assistance to protect the public health and safety.
