Section 4.182 - Executive order no. 182: establishing a temporary commission on high speed rail and maglev transportation development

WHEREAS, the economic well being of New York State is dependent on the availability of efficient transportation services to move goods and people for commercial, social and recreational purposes;

WHEREAS, the State's and Nation's existing intercity transportation networks rely heavily on highways and airports, which do not have the capacity to meet future projected travel demands;

WHEREAS, the State and Nation are seeking ways to reduce air pollution and reduce our dependence on petroleum-based energy through improved and new methods of transportation;

WHEREAS, the transportation research and manufacturing industry in New York State has the potential to become the world leader in producing the vehicles and infrastructure necessary to support High Speed Rail and Maglev services worldwide; and

WHEREAS, it is essential that the State have the cooperation and expertise of the private sector in order to develop and implement High Speed Rail and Maglev and make New York the world's leading center for transportation research and manufacturing;

NOW, THEREFORE, I, MARIO M. CUOMO, Governor of the State of New York, by virtue of the authority vested in me by the Constitution and Laws of the State of New York, do hereby order as follows:

I. Creation of a Temporary Commission

There is hereby established a Temporary Commission on High Speed Rail and Maglev Transportation Development.

II. Membership
1. The Commission shall consist of the Lieutenant Governor, the Commissioner of Transportation, the Commissioner of Economic Development, the Commissioner of Energy, and nine other members who shall be appointed by and serve at the pleasure of the Governor. Of the nine additional members, one shall be appointed upon the recommendation of the Temporary President of the Senate, one shall be appointed upon the recommendation of the Speaker of the Assembly, one shall be a representative of the New York State Thruway Authority, one shall be a representative of the Power Authority of the State of New York, and five shall be representatives of the private sector. The Lieutenant Governor shall serve as chairperson of the Commission.
2. Members of the Commission shall receive no compensation for their services as members, but shall be reimbursed for all actual and necessary expenses incurred in the performance of their duties. Service on the Commission shall not constitute public employment for purposes of disqualification from the holding of public office or employment.
III. Powers and Duties

The Commission shall have the power and duty to:

1. evaluate the economic potential of the development, construction and operation of High Speed Rail and Maglev systems, including all necessary supporting industries and services, and possible innovative applications of Maglev technology;
2. develop a strategy to harness the cooperation and expertise of the private sector in developing and building High Speed Rail and Maglev services;
3. create advisory committees to provide advice on specific issues that impact communities, businesses, and the environment in relation to developing High Speed Rail and Maglev services; and
4. conduct public meetings or other forums, to elicit the opinions of citizens and businesses on the development of High Speed Rail and Maglev services.
IV. Staffing

The Commission shall be authorized to use existing staff and resources of the State, and every department, division, agency, authority, commission, board, bureau and office of the State shall cooperate fully with the Commission and shall provide such assistance as the Commission shall deem necessary or desirable for the accomplishment of its duties.

V. Reporting

The Commission shall prepare and submit reports to the Governor setting forth its findings and recommendations. Recommendations shall include strategies to facilitate the enhancement and development of key industry and research groups necessary to implement High Speed Rail and Maglev services, including but not limited to: transportation equipment, track and guideway construction, electronic components and semiconductors, construction and construction materials, signalling and safety equipment, super conductive magnets, computer services and engineering services.

The Commission shall submit an interim report by December 31, 1994, making initial recommendations, including any proposed legislation deemed necessary to develop and implement High Speed Rail and Maglev services. A final report containing all of the Commission' s recommendations shall be issued by December 31, 1995.
