N.Y. Comp. Codes R. & Regs. tit. 9 § 4.16
WHEREAS, the continued economic vitality and future economic growth of New York State depend upon the cooperation and common dedication of all sectors of society; and
WHEREAS, State government will require the assistance and expertise of those outside government to respond effectively to the economic challenges and fiscal problems that confront New York; and
WHEREAS, there is a need to plan more effectively, set priorities among various projects and coordinate the development and construction activities of State agencies and public authorities;
NOW, THEREFORE, I, Mario M. Cuomo, Governor of the State of New York, by virtue of the authority vested in me by the Constitution and Laws of the State of New York, do hereby establish within the Executive Chamber a Council on Fiscal and Economic Priorities.
The council shall consist of 22 members appointed by the Governor, one of whom shall be designated by him to serve as chairman. The members shall include representatives of business, labor, the academic community, nonprofit organizations and local government. The members of the council shall receive no compensation, but shall be entitled to reimbursement for any necessary expenses incurred in connection with the performance of their duties.
The council shall advise and assist the Governor in the formulation of the State's overall economic strategy. In discharging this responsibility, the council shall:
Develop overall State strategies and specific program initiatives to combine the resources of government, business, labor and other sectors of society in order to strengthen New York's economy and create jobs.
Make recommendations on overall State taxation and expenditure policies, and report on the effect which changes in such policies may have on the State' s economy.
Assist the Governor and other State officials in identifying the most pressing needs for rebuilding the State's capital plant and for undertaking new projects to maintain and improve the State's infrastructure of roads, rails, ports and water systems.
Assist the Governor in formulating, in cooperation with State agencies and authorities, a five- year capital plan covering all State and authority financing and construction to be initially completed by July 1, 1983, and updated annually thereafter.
Identify methods for financing capital developments without increasing the burden borne by the State's taxpayers.
Formulate policies aimed at assuring that the development programs of the State and public authorities provide employment, entrepreneurial and training opportunities to the unemployed and underemployed, minorities, women and young people.
Assist the Governor and other State officials in developing plans for rationalizing the health and education capital planning, construction and financing processes.
Advise the Governor concerning Federal policies and actions that may affect the State's fiscal and economic condition.
All departments, divisions, boards, offices and public corporations of the State are directed to cooperate with the council and to provide such assistance as the council may request to fulfill its purposes. Such assistance may include, but need not be limited to, the use of agency staff, the provision of statistical and policy data in such form as is determined by the council and consultation with agency staff as the council shall require.

The Council shall receive staff services and assistance from the Department of Economic Development's Division of Policy and Research. All other departments, divisions, boards, offices and public corporations of the State are directed to cooperate with the Council and to provide such assistance as the Council may request to fulfill its purposes. Such assistance may include, but need not be limited to, the use of agency staff, the provision of statistical and policy data in such form as is determined by the Council and consultation with agency staff as the Council shall require.
