Section 4.133 - Executive order no. 133: establishing the forms simplification/reduction program advisory council

WHEREAS, the Executive Branch of State government in 1984 embarked upon an effort to reduce the amount of paperwork State government requires of business and the public by simplifying procedures and eliminating unnecessary forms;

WHEREAS, under the leadership of the Office of Business Permits and Regulatory Assistance and the Office of Management and Productivity, the Forms Simplification/Reduction Program has saved businesses, local governments, the general public and State agencies time and money in handling State paperwork;

WHEREAS, the future success of this effort depends upon the coordination of participating State agencies and their commitment to share and apply innovative streamlining techniques;

WHEREAS, this collaborative statewide effort will benefit from the experience and insight of a Council comprising selected agency and business representatives;

NOW THEREFORE, I, Mario M. Cuomo, Governor of the State of New York, by virtue of the authority vested in me by the Constitution and Laws of the State of New York, do hereby establish the Forms Simplification/Reduction Program as an ongoing program of State government to be administered by the Office of Business Permits and Regulatory Assistance and supported by a Forms Simplification/Reduction Program Advisory Council.

I. Powers and Duties of the Office of Business Permits and Regulatory Assistance.
1. The Office of Business Permits and Regulatory Assistance will develop, implement, coordinate and monitor a plan to continue the active participation of all State agencies in the Forms Simplification/Reduction Program.
2. The Office of Business Permits and Regulatory Assistance will act as the liaison to State agency team managers to ensure that each agency continues to carry out a systematic program to simplify and eliminate unnecessary paperwork.
3. The Governor's Office of Employee Relations will, in concert with the Office of Business Permits and Regulatory Assistance, provide the necessary training to agency team managers and support staff to improve forms management in all State agencies.
4. The Office of Business Permits and Regulatory Assistance will meet with members of business, government and other associations as needed to ensure direct input from those most affected by State forms requirements.
5. The Office of Business Permits and Regulatory Assistance will annually report to the Governor the agencies' efforts to simplify forms and reduce paperwork, and the number of forms inventoried in each of those agencies.
II. Forms Simplification/Reduction Program Council/Membership.

A Governor's Forms Simplification/Reduction Program Advisory Council is hereby established to evaluate annually the progress of the program and to establish goals and objectives for the following year. This Council shall be chaired by the Director of the Office of Business Permits and Regulatory Assistance, and shall consist of: one representative from the Office of Management and Productivity, one representative from the Office of Employee Relations and one representative from the State Archives and Records Administration, each representative to be designated by the respective agency head; one representative from three agencies to be designated by the Chair; and two representatives from the business community, to be designated by the Chair. The Council shall meet as directed by the Chair.

III. Responsibilities of Agencies.

Every State Agency shall:

1. inform managers of the importance of this program and designate an individual as the Forms Simplification/Reduction Program team manager who shall have access to the agency head and who can command the cooperation of both administrative and program staffs.
2. ensure that agency team managers and other appropriate staff actively participate in forms management training programs.
3. comply with timetables established by the Office of Business Permits and Regulatory Assistance for systems improvements and submission of progress reports.
