Section 10A:4-12.2 - Zero tolerance policies

(a) The following zero tolerance policies, as defined in 10A:1-2.2, are maintained by the Department:

1. "Zero Tolerance Drug/Alcohol Policy"; and

2. "Zero Tolerance for Misuse or Possession of an Electronic Communication Device Policy."

(b) In accordance with the Federal Prison Rape Elimination Act of 2003 (PREA), 42 U.S.C. §§ 15601 et seq., the Department maintains a zero tolerance for the incidence of sexual assault.
