Section 10A:13-5.4 - Job/wage variance request, form and handling(a) When deemed necessary, a job/wage variance shall be requested and submitted to the correctional facility IJWC by the inmate job supervisor or the correctional facility staff member associated with the job. Inmates may suggest a job/wage variance to their job supervisor or to the staff member associated with the job; however, only job supervisors or other staff members associated with the job may submit a job/wage variance to the correctional facility IJWC. Inmates shall not be permitted to submit a job/wage variance request to the correctional facility IJWC.(b) The correctional facility IJWC shall review all requests for job/wage variances in accordance with N.J.A.C. 10A:13-5.3 and shall provide a recommendation for approval/disapproval to the correctional facility Administrator. The IJWC shall provide a written reason(s) to the Administrator for the recommendation.(c) Should the Administrator disapprove the request; the request shall be returned to the correctional facility IJWC for distribution to the requesting staff member and no further action shall be taken. Should the Administrator approve the request, the Administrator or designee shall complete Form 620, Job/Wage Variance and submit Form 620 to the Central Office IJWC.(d) The Central Office IJWC shall review all job/wage variance requests submitted on Form 620 by Administrators or designees. The Central Office IJWC shall make a recommendation to approve or disapprove the request and shall submit Form 620 to the Commissioner or designee for review and final approval/disapproval. The determination of the Commissioner or designee shall be the final level of review and finding of the New Jersey Department of Corrections. The Commissioner or designee shall provide a copy of the final determination to the Central Office IJWC for distribution.N.J. Admin. Code § 10A:13-5.4
