Section Phy 303.06 - The Board's Processing of Requests to Re-Take the National Physical Therapy Examination for the Fourth Time(a) If the board, after receiving a request to re-take the examination for the fourth time, requires further information or documents to determine the individual's eligibility, the board shall: (1) So notify the individual within 60 days; and(2) Specify in writing the information or documents it requires.(b) If the board requests further information or documents, the request to re-take the examination for the fourth time shall not be considered to be completed until the board's office has received the information and documents.(c) The board shall deny the request to re-take the examination for the fourth time if its office has not received the requested information or documents within 8 weeks.(d) The board shall, as soon as possible but no later than 120 days following receipt by the board's office of the completed request to re-take the examination for the fourth time: (1) Communicate to FSBPT its approval for the re-examination; or(2) Mail a letter of denial of re-examination: a. Enclosing reimbursement of the payment made for transcribing eligibility records;b. Stating the reason(s) for the denial; andc. Stating the individual's right to challenge the denial by submitting a written request for a hearing: 1. Within 60 days of the board's notification of the denial; or2. If the individual requesting the hearing is on active military duty outside the United States, within 60 days of his or her return to the United States or release from duty, whichever occurs later.N.H.
