Section He-W 544.16 - Hospice Payment for Recipients in Nursing Facilities(a) No medicaid payments shall be made directly to a residential care or nursing facility.(b) When hospice services are provided to a recipient residing in a nursing facility, the hospice provider shall:(1) Bill for, in addition to routine or continuous home care, room, and board; and(2) Be reimbursed by medicaid at a room and board rate which is, in accordance with 42 U.S.C. 1396d, at least 95% of the per diem rate that would have been paid to the nursing facility for the recipient for the same dates of service under rates established in accordance with He-P 803.N.H. Admin. Code § He-W 544.16
