Section He-C 6443.07 - Referral for Evaluation by the Division

If a student subject to the jurisdiction of the court pursuant to RSA 169-B, 169-C, 169-D, 170-C or 463 exhibits indicators of an educationally disabling condition, the division shall refer the student to:

(a) The legally liable school district for an evaluation pursuant to Ed 1107; or

(b) To the department of education for an evaluation pursuant to Ed 1107 if the legally liable school district refuses to conduct the evaluation.
