Section Env-Wt 604.02 - General Criteria for Tidal Buffer Zones(a) The 100-foot statutory limit on the extent of the tidal buffer zone shall be measured horizontally.(b) Any person proposing a project in or on an undeveloped tidal buffer zone shall evaluate the proposed project based on: (1) The standard conditions in Env-Wt 307;(2) The avoidance and minimization requirements in Env-Wt 311.07 and Env-Wt 313.03;(3) The approval criteria in Env-Wt 313.01; (4) The evaluation criteria in Env-Wt 313.05;(5) The project specific criteria in Env-Wt 600;(6) The CFA required by Env-Wt 603.04; and (7) The vulnerability assessment required by Env-Wt 603.05.(c) Projects in or on a tidal buffer zone shall preserve the self-sustaining ability of the buffer area to provide habitat values, protect tidal environments from potential sources of pollution, provide stability of the coastal shoreline, and maintain existing buffers intact where the lot has disturbed area defined under RSA 483-B:4, VI.N.H.
