Section Env-Wt 604.01 - General Criteria for Tidal Beaches, Tidal Shoreline, and Sand Dunes(a) Any person proposing a project in or on a tidal beach, tidal shoreline, or sand dune, or any combination thereof, shall evaluate the proposed project based on: (1) The standard conditions in Env-Wt 307;(2) The avoidance and minimization requirements in Env-Wt 311.07 and Env-Wt 313.03;(3) The approval criteria in Env-Wt 313.01;(4) The evaluation criteria in Env-Wt 313.05;(5) The project specific criteria in Env-Wt 600;(6) The CFA required by Env-Wt 603.04; and(7) The vulnerability assessment requiredby Env-Wt603.05.(b) New permanent impacts to sand dunes that provide coastal storm surge protection for protected species or habitat shall not be allowed except to protect public safety and only if constructed by a state agency, coastal resiliency project, or for a federal homeland security project.(c) Projects in or on a tidal beach, tidal shoreline, or sand dune shall support integrated shoreline management that:(1) Optimizes the natural function of the shoreline, including protection or restoration of habitat, water quality, and self-sustaining stability to flooding and storm surge; and(2) Protects upland infrastructure from coastal hazards with a preference for living shorelines over hardened shoreline practices.N.H.
