Section Csp 304.02 - Determinations Reserved for Commission ActionAll determinations set forth below shall be made by the trustee only upon approval of the commission in accordance with Csp 102:
(a) Establishing or amending the trust documents; (b) Designing the marketing and promotional program for the plan; (c) Designing all trademarks, service marks, trade names and other promotional indications for the plan; (d) Selection of the investment vehicles for the plan; (e) Selection of any private vendor to provide services to the plan; (f) Establishing or amending any agreement between the trust and any private vendor; (g) Designing any program to expend general funds held by the trust that are not held for the benefit of a designated beneficiary; (h) Resolving any dispute concerning an interpretation of the terms of the trust documents that arise between the trustee and a participant or a designated beneficiary; (i) Authorizing the payment of assessment proceeds to the treasurer to reimburse the treasurer for costs and expenses incurred as trustee; and (j) Using any funds that the trustee determines are not required for the administration and operation of the trust.N.H.
